Builder's Warranties in Florida

A builder's warranty guarantees that Florida new construction meets standards of quality, workmanship, and habitability, providing homeowners with contractual and implied protections against defective work.

Warranty Periods

Florida builder warranties typically cover workmanship and materials (1 year), mechanical systems (2 years), and structural components (10 years). The implied warranty of habitability may extend beyond these contractual terms. The 10-year statute of repose under Section 95.11(3)(c) sets the outer boundary for all construction claims.

Claims Process

Homeowners must follow the warranty claim procedures specified in the warranty document. If the builder fails to honor the warranty, Chapter 558 requires 60-day written notice before filing suit, giving the builder an opportunity to inspect, offer repairs, or settle. Documentation of defects through photographs and written records is essential for successful claims.
