In Camera Inspection in Florida Court
An in camera inspection is a private judicial review of documents, evidence, or testimony in Florida court proceedings. The judge examines the material alone, without the parties or public present, to determine whether it should be disclosed, admitted, or kept confidential. This procedure is most commonly used to resolve privilege disputes during discovery.
When In Camera Inspection Is Ordered
Florida judges order in camera inspections when:
- Privilege disputes: One party claims documents are protected by attorney-client privilege or work product doctrine; the opposing party challenges the claim
- Overbroad privilege assertions: The producing party’s privilege log is insufficient to evaluate the claim without reviewing the actual documents
- Confidential information: Trade secrets, proprietary business data, or personnel records require judicial evaluation before disclosure
- Sealed court records: A party seeks to unseal records; the court must review them first
Procedure Under Florida Rules
- Motion: Requesting party files a motion to compel or motion for in camera review under Florida Rule of Civil Procedure 1.380
- Privilege log: Producing party submits a log describing each withheld document and the privilege basis
- Submission: Documents delivered to the court in a sealed envelope or via secure electronic submission
- Review: Judge examines each document individually
- Order: Written ruling specifying which documents are privileged and which must be produced
After the Inspection
- Non-privileged documents: Ordered produced within a specified timeframe
- Privileged documents: Returned to the producing party or maintained under seal
- Sealed materials: Preserved in the court record for appellate review
- Appeal: By petition for writ of certiorari (standard for discovery orders in Florida)
