Mutual Indemnity Agreements
A mutual indemnity agreement provides reciprocal loss protection between parties. Common in leases, construction, joint ventures, and service contracts. Florida’s anti-indemnity statute (Section 725.06) voids construction indemnity for the indemnitee’s own negligence.
Structure
- Each party indemnifies for their own acts
- Reciprocal protection (not one-way)

- Construction contracts: cannot indemnify for indemnitee’s negligence
- Exception: specified monetary limit + insurance
- Does not apply to non-construction agreements
