Notice to Owner Construction

Definition: A statutory notice that subcontractors and material suppliers must serve on the property owner to preserve their right to file a construction lien under Florida's Construction Lien Law. Must be served within 45 days of first furnishing labor or materials.

Florida Notice to Owner (NTO) Details

A late NTO does NOT completely eliminate lien rights; the lien is limited to owner’s unpaid amounts at service time. After receiving NTOs, owner must verify sub payment before paying contractor (Section 713.06(3)(h) "improper payments"). Best practice: NTO tracking + progress lien waivers (Section 713.20).
