Florida Notice to Owner (NTO) Details
A late NTO does NOT completely eliminate lien rights; the lien is limited to owner’s unpaid amounts at service time. After receiving NTOs, owner must verify sub payment before paying contractor (Section 713.06(3)(h) "improper payments"). Best practice: NTO tracking + progress lien waivers (Section 713.20).
Late NTO Consequences
- Lien limited to unpaid amounts at service time
- If owner paid in full: potentially no lien rights
- Early service maximizes lien protection
Owner Payment Obligations
- Verify sub payment before paying GC
- Obtain partial lien releases
- Improper payments: no protection from liens
Lien Waivers
- Progress and final waivers (Section 713.20)
- Contractor’s final affidavit
- Track NTOs + require waivers = best protection
