Undue Influence Testamentary Capacity Contest

Definition: Improper influence exerted over a testator (the person making a will or trust) that overcomes the testator's free will and causes the testator to make dispositions they would not have otherwise made. Undue influence is a grounds for contesting a will or trust.

Undue Influence and Testamentary Capacity in FL Contests

FL undue influence + capacity (Section 732.5165): separate grounds, can raise both. Capacity: understand will, property, beneficiaries, and disposition. Influence: overcome free will. Overlap: diminished capacity = more vulnerable. But capacity + influence not mutually exclusive. Strategy: raise both (if one fails, other may succeed). Medical records: critical (dementia, cognitive decline, medications, vulnerability). Expert: gerontologist or neuropsychologist. Court evaluates independently.
