Youthful Offender Adjudication Withhold

Definition: A disposition in which the court finds sufficient evidence to convict but withholds the formal adjudication of guilt, allowing the defendant to avoid the consequences of a criminal conviction. Commonly used for first-time and youthful offenders in Florida.

FL Youthful Offender: Adjudication Withheld

FL adjudication withheld (Section 948.01): guilty finding but no formal conviction. YO completes probation/program without felony conviction. Benefits: no felony for most purposes, better employment/housing, civil rights retained (voting, jury), and record sealing eligible (Section 943.0585). Court considers: offense nature, background, victim input, State Attorney, and rehab potential. Cannot withhold for: DUI 3rd+, trafficking, and certain violent felonies. Arrest + withhold still on record.
