Notice of Non-Responsibility in Florida Construction
A notice of non-responsibility disclaims owner liability for unauthorized tenant construction work. Chapter 713 does not specifically recognize it (unlike some states), but posting may help establish owner non-authorization. Best protection: lease provisions restricting tenant improvements and requiring lien waivers/bonds.
Purpose
- Disclaim liability for tenant construction
- Prevent liens from attaching to fee interest
- Establish owner did not authorize work
FL Effectiveness
- Not specifically recognized in Chapter 713

- Creates record of owner’s position
